RENTAL AGREEMENT:
By entering into this rental agreement, you are accepting the following:
The tenant (that's you) and the owner (that's us), agree to the following:
THE TENANT WILL:
- maintain the house and property in the same condition it was upon arrival
- treat the house, contents and property in a respectful and responsible manner
- refrain from smoking anywhere within the rental retreat
- if smoking outside, dispose of any and all butts in a safe manner, in the containers provided
- refrain from any substance abuse and excessive consumption of alcohol
- refrain from rowdiness and loud music
- refrain from any "rewiring" of stereo and entertainment system. All games brought by guests are to be played on rec room television only which has front access ports. Reinstatement of any "rewiring" done by guests will be charged on a hourly basis (minimum $50) and deducted from the security/damage deposit.
- not dispose of kleenex, paper towels, diapers or feminine hygiene products down toilets
- immediately inform the owner of any problems or accidents (contact list is posted on the property)
- be responsible for any acts of malice, accidental or purposeful damage to property and equipment by tenant or tenant's guests
- accept responsibility for the actions and behaviour of all persons occupying the rental property
- accept that there are risks involved to persons due to water, wildlife, traffic, etc. that are each individual's responsibility and not hold the owner responsible or liable in any manner should an accident occur
- upon booking, receive via e-mail or fax, a copy of this agreement (a copy is also available upon arrival)
- upon booking, receive via e-mail or fax, a copy of the rental contract
- upon booking, advance a non-taxable, refundable security/damage deposit (which will be credited back to you the weekend following your departure -- property is checked by staff after each departure for damage and/or missing items. Any discovery of either will be deducted from your security deposit)
- have the right to cancel the contract up to 90 days prior to the date of rental with no penalty whatsoever and a full refund of all deposits (security and booking)
- have the right to cancel the contract less than 90 days prior to the date of rental with the following penalties:
- 90-60 days prior to date loss of 100% of booking deposit; any rentals monies refunded
- 60-30 days prior to date loss of 100% of booking deposit; loss of 1/2 total rental monies
- 30 days or less prior to date loss of 100% of booking deposit; loss of total rental monies
- Should you find another client to take your rental timeframe, all monies will be refunded to you; less a $100 administration fee
- Should we be able to find another client to take your rental timeframe, all monies will be refunded to you; less a $250 administration fee
- arrive at or after the arrival time specified in the contract
- depart before or at the departure time specified in the contract in consideration of the staff and the following client
- acknowledge that failure to depart promptly will result in the following penalty: $50 per hour
- acknowledge that any time spent to reinstate entertainment system "alterations" will result in the following penalty: $50 per hour (minimum charge: $50)
- acknowledge that there are extenuating circumstances in life and work in a co-operative, reasonable and fair manner with the owner should such an event occur
- not allow the property to be occupied by any persons other than those intended by the contract
- understand that failure to comply to any of the above constitutes termination of the rental agreement and the possible removal of all persons from the rental property with absolutely no refund
- any pets allowed on property must be leashed when outside for their safety and in compliance with local by-laws
- pet owners are responsible for removal of all pet feces outside; clean-up and removal of any pet excretement inside retreat
- leave the retreat in a clean and tidy state upon completion of rental -- kitchen cleaned up, dishes in dishwasher, food emptied from fridge, garbage and recycling in garage, barbecue tidy, floors swept. Towels, linens and bedding are not your responsibility -- the cleaning staff will look after them.
THE OWNER WILL:
- provide the house, contents and property in clean and reasonable condition for your arrival as described
- solve any problems the tenant may have to the best of the owner's ability
- fix any mechanical, electrical, plumbing problem as quickly as possible upon being informed by tenant of such a problem
- be responsible for the cost of all repairs under acts of god, failure of equipment and items of that nature
- provide all of the inclusions as listed
- provide a contact list for emergency use or questions by the tenant while on the property
- promptly refund the tenant's security deposit upon inspection following departure and completion of contract. Any penalties or missing items will be described and deducted from security/damage deposit before refund
- provide extra services agreed to in the written contract with tenant
- acknowledge that there are extenuating circumstances in life and work in a co-operative, reasonable and fair manner with the tenant should such occur
- not accept any responsibility whatsoever for any personal injury of any type, for any reason while tenant is occupying rental property or on neighbouring properties
- have the right to evict and remove any and all persons from the rental property should the tenant (or anyone occupying the rental property during agreement) fail to comply with the terms as listed above with no refunds.
